Terms, returns and refunds
Who you are buying from, how a contract is formed, your 14 day right to change your mind, and what happens when something is faulty.
These terms cover anything bought through this site. They sit alongside your statutory rights as a consumer and do not replace them. Where a term here gives you less than the law gives you, the law wins.
Who you are buying from
This block is not filled in yet and must be completed before the shop is legally compliant. Consumer law requires a trader to publish its legal identity, registered address and registry number where a buyer can find them before ordering.
- Registered company name: [TO BE COMPLETED]
- Registry or company number: [TO BE COMPLETED]
- VAT number, if registered: [TO BE COMPLETED]
- Registered address: [TO BE COMPLETED]
- Country of establishment: [TO BE COMPLETED]
- Address for returned goods: [TO BE COMPLETED]
- Telephone, if one is published: [TO BE COMPLETED]
Email reaches us at team@molotovatelier.com. We answer there, and that is the address to use for anything in these terms: questions, withdrawal, faults and complaints.
What you are buying
Pieces are built and finished by hand and then covered in art before the clear coat, so no two are identical. Grain, colour, the exact position of sprayed detail and small variations in finish are a property of the work, not a defect. Photographs on the site show a representative piece, and the one you receive will differ in those ways. Dimensions and weights listed on a product page are the target figures the workshop builds to.
A piece marked sold out is gone. Where a run is numbered, your piece carries its own number, stamped on the underside.
Prices
Prices are in euro and are the price you pay for the piece. Shipping is added at checkout: 38 euro, or free when the subtotal reaches 1 000 euro. The full total appears before you pay.
Orders delivered to Norway, Switzerland and the United Kingdom can attract import VAT, duty and a carrier handling fee on arrival, which are set by the destination country and are the buyer's to settle. See shipping.
How an order becomes a contract
Adding a piece to the cart changes nothing. Payment is taken through Stripe Checkout, and the contract is formed when we confirm the order by email after that payment succeeds. If a piece has sold between your order and our confirmation, we will tell you and refund you in full.
Payment
Payment is handled by Stripe. We never see or store your card number. The payment methods Stripe offers at checkout depend on your country and currently include cards and several European methods. Your card statement shows the merchant name registered with Stripe.
Returns and your right to change your mind
If you are a consumer buying at a distance, EU consumer law gives you 14 days to withdraw from the contract without giving any reason. The 14 days run from the day you, or someone you nominated other than the carrier, take physical possession of the piece. Where an order is delivered in more than one shipment, the period runs from the last one.
This is separate from a piece arriving damaged or faulty, which is covered further down and costs you nothing.
What the right does not cover
The law excludes goods made to the buyer's own specification or clearly personalised. In practice that means:
- A catalogue piece built after you order it still carries the full 14 day right. Made to order describes when we build it, not who it was designed for.
- A piece you asked us to change carries no right of withdrawal. A custom RAL colour, a non standard size or any other change you specified makes it yours alone, and we cannot sell it to anyone else. Where you ask for that, we will say so in writing before you commit.
How to withdraw
Email team@molotovatelier.com within the 14 days with a clear statement that you are withdrawing, and your order number. You can write it in your own words. Something like this is enough:
I withdraw from my contract for order [number], received on [date]. [Name, address, date.]
Sending the message inside the 14 days is what counts, not when the piece gets back to us.
Sending the piece back
Return the piece without undue delay and no later than 14 days after you tell us you are withdrawing.
- You pay the direct cost of return. Furniture of this weight cannot go back by post and needs a pallet carrier.
- [TO BE COMPLETED] Estimated cost of returning a piece by pallet carrier within the shipping area. The law requires this estimate to be given before you order, so this figure has to be filled in.
- Pack it as it arrived, on its pallet, in its original wrap. Keep the packaging until you are sure you are keeping the piece.
- You may unpack a piece and handle it as you would in a shop to see what it is and whether it works. Handling beyond that which reduces its value can be deducted from your refund. Using a table for a month, or re-spraying it, is beyond that.
Getting your money back
We refund within 14 days of being told you are withdrawing, using the same payment method you used, with no fee for the refund itself. The refund covers the price of the piece and the standard delivery cost you paid to receive it. We may hold the refund until the piece is back with us or until you show proof that you have sent it, whichever comes first.
If a piece is faulty
Separately from the 14 days above, you have a statutory guarantee that what you receive conforms to what was described. In the EU that period is at least two years from delivery. If something is wrong with the piece, tell us at team@molotovatelier.com with photographs and we will repair it, replace it where the piece can be remade, or refund it. You do not pay for return carriage on a faulty piece.
Normal wear is not a fault, and neither is the ageing the materials are expected to do. What each material does over ten years sets out what that looks like, and the guide covers the care each finish needs.
Damage in transit
Damage that happened on the way to you is ours to resolve. The steps, and what to write on the delivery note before you sign, are on the shipping page.
Complaints and disputes
Write to team@molotovatelier.com first. We would rather fix a problem than argue about it.
[TO BE COMPLETED] The national consumer dispute body a buyer can escalate to, and the national consumer protection authority, both of which depend on the country of establishment above.
Law and jurisdiction
[TO BE COMPLETED] The governing law, which follows the country of establishment above. Note that a consumer resident in another EU country keeps the protection of the mandatory consumer rules of their own country whatever this clause says, so it cannot be used to reduce them.
Changes
We may update these terms. The version that applies to your order is the one published when you placed it. The date at the top of this page is when it last changed.
